Approval and Implementation Process

Once a proposed new enterprise agreement has been negotiated by the bargaining representatives, it is put to a vote of the staff members covered by the agreement.

If staff members do not vote in favour of the proposed new agreement, the bargaining process may need to start over.

If staff members do vote in favour of the proposed new agreement, it must be submitted to the Fair Work Commission for approval. The approval process ensures the agreement meets the minimum national employment standards and that each staff member will be better off overall under the new agreement (when compared to the equivalent relevant Award). 

The new agreement must be approved by the Commission before it can come into operation, which is usually seven days after the agreement is approved.
